These Terms of Service ("Terms") cover the Ferrabelle Android app, the Ferrabelle web app at ferrabelle.app, and this website (ferrabelle.com). Ferrabelle is made by Chris Ayers, an independent developer in Washington State ("Ferrabelle," "we," "us"). By installing or using Ferrabelle, you agree to these Terms. If you do not agree, do not use Ferrabelle.
1. Who can use Ferrabelle
You must be at least 18 years old. You confirm this when you set up the app.
2. What Ferrabelle is
Ferrabelle is a general wellness app for tracking your menstrual cycle, body, training, symptoms and related insights. We may add, change or remove features over time.
3. Not medical advice
Ferrabelle is for general wellness and education only. It is not a medical device and not a form of contraception or birth control. Do not use it to prevent pregnancy. It does not diagnose, treat, cure or prevent any disease or condition. Predictions, scores, insights and anything the optional AI assistant says are estimates and can be wrong. Always ask a qualified health care professional about medical decisions.
4. Free app and Pro
- Free to download: the Android app is free on Google Play. Cycle tracking, predictions, all logging (including voice logging and lab report scans), Health Connect, imports, reminders, backups, moving to a new phone, export and deletion are free and stay free.
- Pro, once: an optional one-time Pro unlock, sold through Google Play for the price shown in the app, in your local currency, which may differ by country, adds extra features. There are no subscriptions and no ads.
- Google Play's terms apply to the purchase, including Google Play's refund policy. Refund requests go through Google Play. A refunded Pro unlock turns Pro off again; your data stays.
- Your license: we give you a personal, non-transferable license to use the app, and Pro if you bought it, on devices linked to your Google Play account, under these Terms and Google Play's terms.
5. Your data is yours, and on your phone
You own what you put into Ferrabelle. The Android app stores it on your phone and does not send it to us, as described in the Privacy Policy and the Consumer Health Data Privacy Policy. That also means you are responsible for your backups:
- If you lose or reset your phone without a backup, we cannot recover your data, because we never had it.
- Backup files are encrypted with a passphrase only you know. If you forget it, no one can open the backup, including us.
6. Optional features that use other services
The AI assistant, partner messages and saving backups to a cloud drive are optional and off until you turn them on. When you use them, you send information to a service you choose, such as an AI provider, Discord, Telegram, your messaging app or your cloud drive. Those services are run by other companies under their own terms and privacy policies, and you are responsible for following them. Some AI providers do not allow other apps to use your subscription sign-in, so Ferrabelle never asks for it; it uses your own key, your own server, an OpenRouter sign-in, or hands the question to the provider's own app instead.
7. Test versions
If you join a test of the app, you get an early version that may have bugs. Please keep your own backups. If you send feedback, we may use it to improve Ferrabelle without owing you anything for it.
8. The web app (existing accounts)
The web app at ferrabelle.app is closed to new accounts. If you have one, you are responsible for your login details and for activity under your account. You can export or delete your account at any time. We may end the web app in the future; if we do, we will give account holders at least 30 days' notice and a way to export their data first.
9. Acceptable use
Do not misuse Ferrabelle: no unlawful use, no trying to access anyone else's data, no disrupting the web app or this website, and no automated scraping of them.
10. Disclaimers
Ferrabelle is provided "as is" and "as available," without warranties of any kind to the fullest extent the law allows, including any warranty of accuracy, fitness for a particular purpose, or that predictions will be correct.
11. Limitation of liability
To the maximum extent the law allows:
- Chris Ayers and our service providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or other intangible losses, arising out of or relating to Ferrabelle, these Terms, or your use of or inability to use the app, web app or website, under any legal theory, even if we were told such damages were possible.
- Our total liability for all claims relating to Ferrabelle is limited to the greater of what you paid for Ferrabelle in the 12 months before the claim arose, or 100 US dollars.
Nothing in these Terms limits liability that the law does not allow to be limited, such as liability for gross negligence, willful misconduct or fraud, or any rights you have under the Washington My Health My Data Act or other consumer protection law. Where a limit is not allowed, it applies only as far as the law permits.
12. Ending use
You can stop using Ferrabelle at any time: delete your data in the app and uninstall it, or delete your web app account. We may suspend web app accounts that break these Terms.
13. Changes to these Terms
We may update these Terms. We will post the new effective date here, and for material changes the app asks for your agreement again before you continue.
14. Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Nothing in these Terms limits any rights you have under the Washington My Health My Data Act or other law that cannot be waived.
